Terms of Service

By using Moxly.ai, you agree to these terms. Please read them carefully.

Limited Power of Attorney

By authorizing Moxly.ai to negotiate on your behalf, you grant us a limited power of attorney strictly for the purpose of bill negotiation and dispute resolution.

What We Can Do

  • βœ“Contact your service providers to negotiate better rates or dispute charges
  • βœ“Review bills, contracts, and statements you provide
  • βœ“Communicate with customer service representatives using your account information
  • βœ“Request billing adjustments, credits, or refunds on your behalf

What We Cannot Do

  • βœ—Make purchases or changes to your service plans without your explicit approval
  • βœ—Cancel your services or close your accounts
  • βœ—Access your account passwords or make changes to account security
  • βœ—Bind you to any new contracts or agreements

This authorization remains in effect until you revoke it by closing your Moxly account or sending written notice to legal@moxly.ai.

Success Fee Model

Moxly operates on a transparent, performance-based pricing model. You only pay when we save you money.

Standard Success Fee

Our standard fee is 10% of the total savings we secure for you.

Example:

Original bill: $120/month

Negotiated bill: $70/month

Monthly savings: $50 β†’ You pay $5 (10%), keep $45 (90%)

Annual savings: $600 β†’ You pay $60, keep $540

Payment Terms

  • β€’Success fees are calculated based on 12 months of projected savings
  • β€’Payment is due within 30 days of successful negotiation
  • β€’If no savings are achieved, you owe nothingβ€”no hidden fees or charges
  • β€’Pro Plan subscribers ($29/month) pay zero success fees

If you're not satisfied with our service within the first 30 days, we'll refund your success fee in fullβ€”no questions asked.

Limitation of Liability

While we strive to provide excellent service, it's important to understand the limits of our liability:

Service Disclaimer

Moxly.ai provides bill negotiation services on an "as is" and "as available" basis. While our AI is highly effective, we cannot guarantee specific results for every negotiation.

  • β†’Service providers have final authority over pricing decisions
  • β†’Some bills may not be negotiable due to contractual obligations
  • β†’Results may vary based on provider, account history, and market conditions

Liability Cap

To the maximum extent permitted by law, Moxly.ai's total liability to you for any claims arising from our services shall not exceed:

The greater of (a) $500 or (b) the total fees you paid to Moxly in the 12 months preceding the claim

Exclusions

We are not liable for:

  • βœ—Indirect or consequential damages: Including lost profits, business interruption, or data loss
  • βœ—Third-party actions: Decisions made by your service providers or billing errors they create
  • βœ—Force majeure: Events beyond our control (natural disasters, government actions, etc.)
  • βœ—Unauthorized access: If you share your account credentials or fail to maintain account security

Account Responsibilities

You are responsible for:

  • β€’Providing accurate and complete billing information
  • β€’Maintaining the security of your Moxly account
  • β€’Promptly notifying us of any unauthorized account access
  • β€’Complying with all applicable laws when using our service

Dispute Resolution

Any disputes arising from these Terms will be resolved through:

  1. Good Faith Negotiation: We'll first attempt to resolve disputes through direct discussion
  2. Mediation: If negotiation fails, disputes will be submitted to binding mediation in Los Angeles County, California
  3. Arbitration: Any remaining disputes will be resolved through binding arbitration under JAMS rules

You waive the right to participate in class-action lawsuits or class-wide arbitration.

Changes to Terms

We may update these Terms from time to time. We'll notify you of material changes via email at least 30 days before they take effect. Continued use of our service after changes constitutes acceptance of the new Terms.
